Terms of Service - Ghost Modifications

1. Agreement to Terms

Welcome to Ghost Modifications.

By purchasing, commissioning, downloading, or using any products or services provided by Ghost Modifications, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service ("Terms").

If you do not agree with these Terms, you may not purchase or use any Ghost Modifications products or services.

2. Services We Provide

Ghost Modifications specializes in custom development and digital services for FiveM communities and gaming organizations, including but not limited to:

Custom FiveM Development
Vehicle Development & EUP
Custom Scripts
Server Framework Development
Server Optimization
Discord Server Development
Discord Bot Development
Web Development
Graphics & Branding
Liveries & Vehicle Textures
CAD/MDT Integrations
Server Installation & Configuration
Technical Consulting
Ticket-Based Customer Support
Monthly Development Plans
Custom Commission Work

All services are provided subject to availability and acceptance by Ghost Modifications.

Ghost Modifications reserves the right to decline any project for any reason.

3. Pricing & Payments

All pricing is quoted in United States Dollars (USD) unless otherwise specified.

Full payment is required before any completed files, scripts, graphics, or products are delivered unless a written payment agreement has been approved.

Certain large-scale projects may qualify for milestone payments at Ghost Modifications' sole discretion.

Prices may change without prior notice.

Quotes remain valid for fourteen (14) calendar days unless otherwise stated.

Any additional work requested outside the original project scope will require additional payment.

Accepted Payment Methods

Ghost Modifications currently accepts:

Stripe, if available

Failure to complete payment may result in project cancellation.

4. Project Timeline

Estimated completion dates are provided as a courtesy only.

Development timelines may change due to:

Project complexity
Client response times
Requested revisions
Holidays
Staff availability
Technical issues

Ghost Modifications is not responsible for delays caused by missing information or delayed communication from the client.

5. Revisions

Unless otherwise stated:

Every project includes up to three (3) minor revisions.
Major redesigns or feature additions are not considered revisions.
Requests outside the agreed project scope will require a new quote.
Unused revisions do not carry over to future projects.

6. Ownership & Intellectual Property

Until Full Payment Has Been Received

All work remains the exclusive property of Ghost Modifications.
Clients receive no ownership rights.

After Payment Has Been Completed

The client receives a non-exclusive, non-transferable, non-resellable, and revocable license to use the delivered work for their own FiveM server or approved project.

Unless specifically authorized in writing, clients may not:

Resell any products
Redistribute files
Share source files
Claim Ghost Modifications' work as their own
Remove copyright notices
Use products in marketplaces
Modify products for resale

Ghost Modifications retains all copyrights to original work unless ownership is specifically transferred through a signed agreement.

7. Client Responsibilities

Clients agree to:

Provide accurate project information.
Respond to requests promptly.
Review deliverables in a timely manner.
Maintain professional communication.
Respect staff members.
Avoid requesting copyrighted, illegal, or stolen content.
Comply with all applicable laws and platform Terms of Service.

Failure to cooperate may delay or terminate a project.

8. Refund Policy

No Refunds After Development Begins

Due to the custom nature of our services, all sales are final once development has started.

Refunds will not be issued for:

Changing your mind
Leaving your FiveM server
Closing your community
Purchasing another developer's work
Dissatisfaction with features that were originally approved
Inactivity by the client
Failure to provide required project information

Refund requests made after work has begun will automatically be denied.

Chargebacks made without contacting Ghost Modifications first will result in immediate service termination and permanent blacklisting.

9. Project Cancellation

Ghost Modifications may cancel or suspend a project if:

Payment is not received.
The client becomes abusive.
Fraud is suspected.
False disputes or chargebacks occur.
The client violates these Terms.
The client becomes inactive for more than thirty (30) consecutive days.

Projects inactive for more than 30 days may be archived without notice.

10. Refusal of Service

Ghost Modifications reserves the right to refuse service to anyone for reasons including, but not limited to:

Harassment
Hate speech
Threats
Fraud
Chargebacks
Criminal activity
Copyright infringement
Excessive abuse of support
Violation of these Terms

11. Support Policy

Official support is available only through our Discord Ticket System.

Support Includes

Installation assistance
Bug reports
Product troubleshooting
Commission updates

Support Does Not Include

Free custom development
Training unrelated to purchased services
Third-party troubleshooting
Modifying products outside the purchased scope

Scheduled Maintenance

Ghost Modifications performs scheduled maintenance approximately every three (3) months.

Maintenance windows generally last between 24 and 96 hours.

Advance notice will be posted through official communication channels whenever possible.

13. Warranty Disclaimer

All products and services are provided "AS IS" and "AS AVAILABLE."

Ghost Modifications makes no warranties, express or implied, including:

Merchantability
Fitness for a particular purpose
Continuous availability
Compatibility with third-party resources
Future FiveM updates
Server uptime

14. Limitation of Liability

Ghost Modifications shall not be liable for:

Lost profits
Lost revenue
Lost player data
Server downtime
Corrupted databases
Third-party plugin conflicts
FiveM platform updates
GTA V game updates
Client misuse
Unauthorized modifications by others

The maximum liability of Ghost Modifications shall never exceed the amount paid for the affected product or service.

15. Chargebacks & Payment Disputes

Initiating a chargeback without first contacting Ghost Modifications to resolve the issue may result in:

Immediate account suspension
Permanent blacklist
Revocation of licenses
Cancellation of all active projects
Removal of future support eligibility

Ghost Modifications reserves the right to dispute fraudulent chargebacks.

16. Privacy

Ghost Modifications respects your privacy.

Information collected during projects is used solely for:

Completing commissions
Providing customer support
Billing
Internal business records

Customer information will never be intentionally sold to third parties.

17. Changes to These Terms

Ghost Modifications reserves the right to modify these Terms of Service at any time.

Updated versions become effective immediately upon publication.

Continued use of our products or services constitutes acceptance of any revised Terms.

18. Governing Law

These Terms shall be governed by the laws of the United States and the State in which Ghost Modifications is legally registered, without regard to conflict-of-law principles.
